If we supply engineering, analysis, consultancy or other professional services to you, those services are governed by a separate written contract between us. We may amend these terms of use at any time by revising this page. Please check this page from time to time; the changes take effect from the date they are posted, and your continued use of the site means you accept them.

We may update and change the site from time to time to reflect changes to our services, our clients’ needs and our business priorities. We do not guarantee that the site, or any content on it, will be free from errors or omissions.

4. Access to the site

The site is made available free of charge. We do not guarantee that the site, or any content on it, will always be available or be uninterrupted. We may suspend, withdraw or restrict the availability of all or any part of the site for business and operational reasons, and we will try to give you reasonable notice of any suspension or withdrawal.

You are responsible for making all arrangements necessary for you to have access to the site, and for ensuring that all persons who access the site through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.

5. Accounts, passwords and file transfer access

If we provide you with a user identification code, password, or any other piece of information as part of our security procedures — including credentials for our file transfer (FTP) facility — you must treat such information as confidential and must not disclose it to any third party.

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at solutions@pdl-group.com.

6. Intellectual property rights

We are the owner or the licensee of all intellectual property rights in the site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may print off one copy, and may download extracts, of any page(s) from the site for your personal use, and you may draw the attention of others within your organisation to content posted on the site.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences, drawings, models or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of content on the site must always be acknowledged. You must not use any part of the content on the site for commercial purposes without obtaining a licence to do so from us.

The content on the site — including project descriptions, case studies, technical articles, specifications, downloadable documents and thought leadership material — is provided for general information only. It is not intended to amount to engineering, technical, safety, regulatory or other professional advice on which you should rely.

Engineering analysis and design assurance depend entirely on the specific facts, assumptions, codes, standards and operating conditions applicable to a particular project. Nothing on the site is a substitute for a project-specific engagement with suitably qualified engineers. You must obtain professional or specialist advice before taking, or refraining from taking, any action on the basis of the content on the site.

Although we make reasonable efforts to update the information on the site, we make no representations, warranties or guarantees, whether express or implied, that the content on the site is accurate, complete or up to date.

8. Our liability

Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our liability for fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to the site or any content on it, whether express or implied.

We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • use of, or inability to use, the site; or
  • use of or reliance on any content displayed on the site.

In particular, if you are a business user, we will not be liable for loss of profits, sales, business or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill or reputation; or any indirect or consequential loss or damage.

If you are a consumer user, please note that we provide the site for domestic and private use only. You agree not to use the site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the site or to your downloading of any content on it, or on any website linked to it.

We assume no responsibility for the content of websites linked from the site. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.

9. Enquiries and information you send to us

If you contact us through the site — including through any contact or enquiry form — you must not send us confidential, commercially sensitive, export-controlled, classified or security-sensitive information. Information submitted through the site is not treated as confidential and is not subject to any non-disclosure agreement unless and until we have agreed one with you in writing.

If you need to share sensitive project information with us, please contact us first so that appropriate confidentiality arrangements and a secure transfer method can be put in place.

You warrant that any information you provide to us through the site is accurate, that you are entitled to disclose it, and that its disclosure to us does not breach any obligation you owe to a third party or any applicable law, including export control legislation.

10. Prohibited uses and acceptable use

  • in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;

  • to access without authority, interfere with, damage or disrupt any part of the site, any equipment or network on which the site is stored, any software used in the provision of the site, or any equipment, network or software owned or used by any third party.

You must not misuse the site by knowingly introducing viruses or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to the site, the server on which the site is stored, or any server, computer or database connected to the site. You must not attack the site via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the site will cease immediately.

11. Export control and sensitive sectors

We work in regulated sectors, including nuclear and defence. The site and its content are not intended for, and must not be accessed, downloaded, exported or re-exported by, any person where to do so would breach applicable export control, sanctions or non-proliferation laws, including those of the United Kingdom.

You are responsible for ensuring that your access to and use of the site complies with all laws and regulations applicable to you in your jurisdiction. Where any of our services or materials are subject to export control, additional restrictions and licensing requirements will apply and will be addressed separately in writing.

12. Linking to the site

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not establish a link to the site in any website that is not owned by you, and the site must not be framed on any other site. Where the site contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources, and such links should not be interpreted as approval by us of those linked websites or the information you may obtain from them.

14. Suspension and termination

We will determine, in our discretion, whether there has been a breach of these terms of use through your use of the site. When a breach has occurred, we may take such action as we deem appropriate, including withdrawing your right to use the site, removing any material you have uploaded, issuing a warning, taking legal proceedings against you, or disclosing such information to law enforcement authorities as we reasonably feel is necessary.

15. Events outside our control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations in relation to the site that is caused by any act or event beyond our reasonable control.

16. General

If any provision of these terms of use is found to be invalid, unlawful or unenforceable by a court or other competent authority, that provision will be deemed severed and the remaining provisions will continue in full force and effect.

If we fail to insist that you perform any of your obligations under these terms of use, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you.

These terms of use, and any dispute or claim arising out of or in connection with them, do not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of their terms.

17. Governing law and jurisdiction

These terms of use, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction, except that if you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in the courts of the country in which you reside.
